LIMITATION OF LIABILITY FOR WEBSITE, RUGGEDMADE CATALOG OR ANY TYPE OF RUGGEDMADE ADVERTISEMENT

In no event shall RuggedMade, its Directors, Officers, Employees, Affiliates, Successors, or Assigns or Other Representatives be liable, whether in contract, warranty, tort (including negligence-whether active, passive or imputed), product liability, strict liability, or other theory, to you, or any other person or entity for any damages (including, without limitation, any direct, indirect, incidental, special, exemplary, punitive or consequential damages) arising out of or in connection with any use of, inability to use, or results of use of, this Website, RuggedMade catalog or any type of RuggedMade advertisement or any content on this Website, RuggedMade catalog or any type of RuggedMade advertisement, even if RuggedMade or its Representative has been advised of the possibility of such damages. If you are dissatisfied with this Website, RuggedMade catalog or any type of RuggedMade advertisement and the content contained therein or these Terms and Conditions, your sole and exclusive remedy is to discontinue use of this Website, RuggedMade catalog or any type of RuggedMade advertisement. If any portion of this limitation is found to be invalid or unenforceable for any reason, then RuggedMade’s total liability to you shall in no event exceed one hundred United States dollars (US $100.00). Some states do not allow the exclusion and limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

LIMITATION OF LIABILITY FOR MERCHANDISE

All merchandise listed in this Website, RuggedMade catalog or any type of RuggedMade advertisement are “as is” (to the extent allowed by law) and, unless otherwise specifically noted, are without warranties of any type, express or implied. RuggedMade disclaims all warranties, including, but not limited to, the Implied Warranty of Merchantability and the Implied Warranty of Fitness, for a particular purpose.

We disclaim any liability for product defect claims that are due to product misuse, improper product selection and/or misapplication and any description, picture or other information communicated does not express or imply a warranty that the products are merchantable or fit for a particular purpose. Any liability for consequential, incidental, special, exemplary, or punitive damages are expressly disclaimed. Our liability in all events is limited to, and shall not exceed, the purchase price paid for the product that gives rise to any liability.

RETURN POLICY

We retain the exclusive and sole right as to whether an item may be returned, exchanged or order cancelled. RuggedMade thus encourages customers to use caution when placing an order, as once placed the order may not be able to be cancelled, nor the item returned or exchanged.

In order to obtain a refund or exchange, written prior approval must be given by RuggedMade. Please request an RMA number by emailing support@ruggedmade.com or by calling 1-855-8RUGGED (1-855-878-4433).

Shipping and handling charges are not refundable.

RuggedMade can not accept returns of gas or diesel-powered items once said items have been oiled and/or gassed, included but not limited to hydraulic components. Abuse, misuse and overloading are not covered under warranty.

At RuggedMade's sole discretion, RuggedMade may impose a twenty percent (20%) restocking fee on items returned.

SHIPPING TERMS

Please make sure you fully understand the terms and conditions that apply to the type of shipping service you select. Additional fees may apply if delivery cannot be completed per these terms.

LESS-THAN-TRUCKLOAD (LTL) FREIGHT SHIPPING

RuggedMade ships all products weighing more than 150 pounds by common carrier. Freight shipments can take 7 to 10 business days, but may arrive sooner. RuggedMade makes every effort to only work with reliable carriers. Nevertheless, carriers do not guarantee delivery dates. Delays may occur in certain situations, such as when shipping to remote destinations, during inclement weather, and around holidays. Therefore, RuggedMade is not responsible for estimated or scheduled delivery times made by the carrier. RuggedMade is not responsible for lost income, labor costs, equipment rental, or any other costs that may be associated with shipping and receiving your order.

FREE FREIGHT

Most of our log splitters and construction equipment ship for free with one of our contracted freight carriers. Free freight service means RuggedMade will ship your item to one of our contracted nearby freight terminals or to an In Area qualified business (see SHIPPING TO A BUSINESS for qualifications). Remote or Out of Area surcharges may be applied. Additional freight surcharges may apply for a few items that are not stocked in all RuggedMade warehouses. Accessories ordered with your freight item may ship separately. We may charge parcel shipping rates for the accessories, but the freight item ships for free.

PICKING UP AT A FREIGHT TERMINAL

Please call before placing your order for information regarding the locations of contracted freight terminals. If a freight terminal is not selected with our assistance before placing your order, we will need to speak with you to make these arrangements prior to booking your shipment. RuggedMade reserves the right to restrict or disqualify orders for free freight terminal delivery. If the nearest contracted terminal is not suitable, an additional surcharge can be applied, or residential delivery to an In Area destination can be arranged for a flat fee of $100 (an additional surcharge may apply for Remote or Out of Area destinations).

SHIPPING TO A BUSINESS

-You must enter the business name on your order.
-The freight company will not call ahead to confirm time of delivery.
-There must not be a residence or residential structure on the property.
-The business must have a clearly posted sign with the business name, it must be open during normal business hours, and there must be someone available to unload the shipment.
-There must be a loading dock and/or fork lift (a skid steer, e.g., Bobcat with forks, or a tractor with fork extensions is acceptable – a bucket with chains is not acceptable.
-If the property is gated, the gate must be open during normal business hours.
-Loading dock or unloading area must be unobstructed and accessible for a 53 foot tractor trailer.

DESTINATIONS WITH LIMITED OR OBSTRUCTED ACCESS

Destinations such gated businesses, golf courses, schools, gravel pits, construction sites, and apartment complexes are considered by the carriers to have limited access. An additional limited access surcharge will apply. It may still be possible to ship to locations like these for a residential shipping fee, so please call us.

SHIPPING TO A FARM

Farms are a unique category. Freight companies do not consider farms to be businesses, even if there is equipment available that can unload the truck. If you wish to ship a product by freight carrier to a farm, please select Residential Delivery (Remote or Out of Area surcharges may apply).

RESIDENTIAL SHIPPING – CURBSIDE DELIVERY

Residential shipping is available for a flat fee of $100 (Remote or Out of Area surcharges may apply). The driver is not required to enter driveways. The driver will deliver the item(s) at the foot of the driveway. The driver is not responsible for repositioning the item to a specific spot, such as in your garage. You are responsible for getting the item from the curb to another part of your property. The trucking company is not obligated to assist, but many are kind enough to help.

REMOTE / OUT OF CONTRACTED AREA DESTINATION FEE

Freight companies charge additional fees to deliver to certain remote destinations, or your desired delivery location may be outside of our contracted area for free freight and additional freight charges may apply. If you live in a remote area, please contact us for a custom shipping quote. If you place your order before speaking with us, we may be required to collect additional shipping fees before your item can ship from our warehouse. Certain items may not be available to ship to some areas for free. Delivery to Remote or Out of Area locations may still be possible (limited by carrier) if a surcharge is paid. If you live in a remote area that is difficult to access, such as on an island, in the mountains, or desert, please call for a custom shipping quote. An alternative is to pick your order up at a nearby contracted freight terminal (call for details). Remote area and Out of Area surcharges are determined by the carrier based on zip code. Please allow more time for delivery to remote areas.

FREIGHT SHIPPING OUTSIDE LOWER 48 STATES

We do not ship via freight outside the lower 48 states. If you would like to pick up your order at a freight terminal or freight forwarding business and make your own arrangements for further shipping to Alaska, Hawaii, Puerto Rico, or Canada, please call us.

DAMAGE AND/OR MISSING ITEMS

Please inspect your items before you sign the delivery receipt from the carrier. If you do not inspect before signing for the delivery, open and inspect your shipment as soon as you get it home. Do not wait. Do not sign for delivery if products show obvious signs of damage. If your product arrives with obvious damage, REFUSE DELIVERY and contact us immediately. If you discover hidden damage after receiving the shipment, call us immediately. We will process the damage claim. Occasionally, the outer packaging may look damaged, but the product inside is perfectly fine. If you suspect concealed damage, notate "Possible Freight Damage" on the delivery receipt while the driver is present. This way, if you discover later that the product is damaged, there is remedy for a damaged freight claim.

FREIGHT DESTINATION ADDRESS CHANGE FEE

If you request changes to the delivery address after the item ships, a $50 re-consignment fee will apply to your order.

PARCEL SHIPPING

UPS GROUND, UPS THREE-DAY SELECT, UPS SECOND DAY AIR

Orders are typically picked up from our warehouse by UPS the next business day after the order was placed. According to the terms of service, which can be found at UPS.com, the day a package is picked up is not counted as the first business day of transit. Transit days begin the business day after the package was picked up. Typical transit times for orders shipped via UPS are as follows:

-UPS Ground: Usually 1-5 business days with delivery time based on distance to destination
-UPS Three-Day Select: Guaranteed delivery within three business days with delivery by end of day
-UPS Second Day Air: Guaranteed second day delivery with delivery typically by end of day

USPS (United States Postal Service)

Orders are picked up by USPS from our warehouse the next business day after the order was placed. According to the terms of service, which can be found at USPS.com, the expected delivery date of Priority Mail service is one to three business days. Delivery times are based on origin, destination, and drop-off time.
